Terms of Service

1. Who you are contracting with

SecPolicy is a service operated by Arnav Sharma ("we", "us", "our"), trading as SecPolicy. By using the service you ("you", "user") are entering into a binding agreement with Arnav Sharma.

2. Acceptance

By creating an account, accessing, or otherwise using SecPolicy, you confirm that you have read, understood, and agree to be bound by these Terms. If you are using the service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, you must stop using the service.

3. The service

SecPolicy is a generative AI tool that helps users draft information security policies mapped to common control frameworks. Generated content is provided as-is to assist drafting and is not a substitute for professional legal, audit, or compliance advice. You are responsible for reviewing, editing, and validating all output before relying on it for any compliance, audit, regulatory, or legal purpose.

4. Acceptable use

You must not misuse the service. In particular, you must not:

  • use the service for any unlawful, fraudulent, or harmful purpose;
  • attempt to gain unauthorised access to the service, other accounts, or our infrastructure (including probing, scanning, scraping, or deploying malware);
  • infringe the intellectual property, privacy, or other rights of any person;
  • generate, request, or attempt to elicit illegal content, deepfakes, hateful content, malware, or content designed to bypass safety controls ("jailbreaking");
  • resell, redistribute, sublicense, or make the service available to third parties other than as part of your own internal use;
  • reverse engineer, decompile, or circumvent any technical limits of the service.

You are solely responsible for the prompts and inputs you submit, for verifying the accuracy and suitability of any output, and for ensuring you have the rights to any content you provide as input.

5. Accounts

You must provide accurate information when registering and keep it up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account.

6. Intellectual property

All right, title and interest in and to the SecPolicy service, software, documentation, branding, and underlying technology remain the exclusive property of Arnav Sharma and its licensors. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the service in accordance with these Terms and the plan you have purchased. As between you and us, you retain ownership of your inputs and of the generated outputs you receive, subject to the rights of third-party AI providers and to your compliance with these Terms. We may remove, restrict, or refuse to generate outputs that violate these Terms or our policies, and we may act on takedown notices from rights holders, including terminating accounts of repeat infringers.

7. Payments and Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Refunds are additionally governed by our Refund Policy.

8. Service availability and warranties

We aim to keep the service available but do not guarantee that it will be uninterrupted, error-free, or that outputs will be accurate, complete, or fit for any particular purpose. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Suspension and termination

We may suspend or terminate your access to the service, in whole or in part, where: (a) you materially breach these Terms; (b) a payment is overdue, reversed, or charged back; (c) we reasonably believe there is a security, fraud, abuse, or legal risk; or (d) you repeatedly or seriously violate our acceptable use policy. You may stop using the service and close your account at any time. On termination, your right to use the service ends, and we may delete account data after a reasonable export window.

10. Liability

To the fullest extent permitted by law, our aggregate liability arising out of or relating to the service is limited to the fees paid by you to Paddle for the service in the 12 months preceding the event giving rise to the claim. We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, revenue, data, or goodwill. Nothing in these Terms limits liability that cannot be excluded under applicable law (such as for fraud, death, or personal injury caused by negligence).

11. Indemnity

You agree to indemnify and hold us harmless from claims arising out of: your inputs or generated outputs you choose to use, your unlawful use of the service, or your breach of these Terms.

12. Changes to these Terms

We may update these Terms from time to time. Material changes will be communicated via the service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law

These Terms are governed by the laws of Australia. The courts of Australia have non-exclusive jurisdiction over any dispute, subject to any non-waivable consumer protection rights you have in your country of residence.
